1. Agreement
These Terms of Service (“Terms”) are a binding agreement between you and NDTAcademy.com, LLC, a Florida limited liability company (“NDT Academy,” “we,” “us”), governing your use of NDTAcademy.com and all courses, examinations, records, and services offered through it (the “Platform”). By creating an account, purchasing a course, or otherwise using the Platform you accept these Terms, our Disclaimer, Limitation of Liability, and Conditions of Use, our Privacy Policy, and the other policies linked above, all of which are incorporated by reference. If you use the Platform on behalf of an employer or organization, you represent that you are authorized to bind that organization.
2. Eligibility and Accounts
You must be at least 16 years old (18 to purchase) and able to form a binding contract. You agree to provide accurate registration information, keep your credentials confidential, and notify us promptly of any suspected unauthorized use of your account. Accounts are personal: one account per individual, and training activity must be performed by the account holder (see the Academic Integrity Policy). Company accounts may administer credits, assignments, and training records for their own personnel only.
3. Identity Verification
Because our certificates document formal training tied to a named individual, we require government-ID identity verification (provided by Persona) before coursework and before certification examinations, and fresh identity check-ins for final examinations. Refusing verification limits the training features available to you. See the Privacy Policy for how verification data is handled.
4. Training Only, No Certification Authority
The Platform provides formal NDT training and records of training. Completion of any course does not certify or qualify you to perform NDT. Certification authority rests exclusively with your employer under its written practice (e.g., SNT-TC-1A, CP-189, NAS410). We make no representation that any employer, Level III, auditor, or authority will accept Platform records. The Disclaimer governs all such matters and controls in the event of a conflict.
5. Purchases, Billing, and Taxes
Prices are listed at checkout and may change prospectively at any time. Payments are processed by Stripe; we never receive or store your full card number. Individual course purchases grant a personal, non-transferable license to access the purchased course for the life of the Platform offering. Corporate credits fund company-assigned course access under the terms shown at purchase. Legacy company seat packs are no longer sold; existing purchases remain recorded under their original terms. You are responsible for applicable taxes. Refunds are governed by the Refund Policy. We may suspend access for chargebacks or payment fraud pending resolution.
6. License and Intellectual Property
All Platform content, lessons, video, narration, diagrams, question banks, simulators, certificates, and software, is owned by or licensed to NDT Academy and protected by copyright and other laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access the content for your own training. You may not copy, record, scrape, download (except materials we expressly make downloadable), resell, sublicense, publicly display, or use Platform content to train competing products or machine-learning systems. 7. Training Records and Certificates
We maintain your course completions, examination attempts, engagement-hour ledger, and certificates as auditable records of training (retained at least 10 years; certificates permanently). Certificates carry a unique verification code and may be verified by third parties at ndtacademy.com/verify-certificate (which displays your name, course, hours, dates, and validity status). We may revoke a certificate obtained through fraud, identity misrepresentation, or violation of the Academic Integrity Policy; revocations are recorded and reflected in verification results.
8. Acceptable Use; Termination
You agree to the Acceptable Use Policy and the Student Code of Conduct. We may suspend or terminate access for violation of these Terms or the incorporated policies, for non-payment, for fraud or attempted record falsification, or where required by law. Where reasonable, we will give notice and an opportunity to respond. On termination your license ends; your training records are retained per our Privacy Policy and retention schedule, and issued certificates remain verifiable unless revoked for cause. You may close your account at any time by contacting info@NDTAcademy.com.
9. Disclaimers; Limitation of Liability; Indemnification
The warranty disclaimers, assumption of risk, exclusion of damages, aggregate liability cap, and indemnification obligations set out in Articles VI-VIII of the Disclaimer, Limitation of Liability, and Conditions of Use apply to these Terms in full and are incorporated by reference.
10. Modifications to the Platform and Terms
We may modify, version, retire, or replace courses and features. Historical completion records always preserve the course version you completed. We may amend these Terms by posting a revised version with a new effective date; material changes will be notified via the Platform or email. Continued use after the effective date constitutes acceptance.
11. Governing Law; Venue; Disputes
These Terms are governed by Florida law, without regard to conflicts principles. Exclusive jurisdiction and venue lie in the state and federal courts sitting in Duval County, Florida. You and NDT Academy each waive trial by jury to the extent permitted by law. If any provision is held unenforceable, the remainder continues in effect; no waiver is implied from any failure to enforce.
12. Miscellaneous
These Terms, together with the incorporated policies and any signed enterprise agreement, are the entire agreement between you and NDT Academy regarding the Platform. You may not assign your rights; we may assign to a successor in interest (including in a merger or acquisition), in which case your records transfer subject to the same retention and privacy commitments. Notices to us must be sent to the contact below; notices to you may be sent to your account email.
